Uncompleted works bonds proposals
Bundaberg Regional Council is proposing amendments to the Planning Scheme policy for development works – uncompleted works bonds.
Consultation on the proposed planning scheme amendment will close on 6 November 2020.
We strongly recommend members to review the material and flag any concerns and their ideas either via a submission to council or comments to the Institute to include in a branch-wide submission.
The purpose and general effect of the proposed amendment is to:
- Clarify minimum requirements for development works to be completed as a pre-requisite for council consideration of uncompleted works bonds
- Identify the value of uncompleted works bonds and timeframes for incomplete works to be completed and operational after approval of the survey plan or commencement of a use
- Outline the lodgement process and documentation required to support the uncompleted works bond, including payment options (cash or bank guarantees), and requirements for receiving bond refunds.
The proposed amendment also seeks to provide better guidance for other types of bonds, including performance bonds and maintenance bonds currently identified within the On-Maintenance procedure in the planning scheme policy.
