Improved body corporate regulations
The Institute’s efforts to work with the government on the review of the Body and Community Management regulations has been fruitful.
Key reforms in the new regulation modules include:

Facilitating electronic voting and electronic attendance at meetings, including the use of ‘live’ electronic voting and remote personal attendance

Facilitating the use of email and other forms of electronic communication for exchanging information and documents within bodies corporate

Rationalising the documents original owners (developers) must now provide to bodies corporate to support effective management of community titles schemes

Encouraging early identification and remedy of building defects by requiring bodies corporate to consider a motion to prepare a defect assessment report at the second annual general meeting.
The new regulations are scheduled to commence on 1 March 2021, giving bodies corporate, unit owners and other stakeholders time to learn about the new regulations and make any necessary adjustments to their processes and procedures.
The reforms included in the new regulations follow Institute input to draft regulation and to the QUT review about body corporate procedural issues, which were finalised in the report titled Final recommendations: Procedural Issues under the Body Corporate and Community Management Act 1997.
New regulations under the Body Corporate and Community Management Act 1997 include:
- Body Corporate and Community Management (Accommodation Module) Regulation 2020
- Body Corporate and Community Management (Commercial Module) Regulation 2020
- Body Corporate and Community Management (Small Schemes Module) Regulation 2020
- Body Corporate and Community Management (Standard Module) Regulation 2020
- Body Corporate and Community Management (Specified Two-lot Schemes Module) Amendment Regulation 2020.
